The Road Accident Fund (RAF) is a state-backed entity that was established to compensate victims of road accidents, which was caused by the negligent or wrongful acts of a driver of a motor vehicle, within the borders of South Africa. The RAF essentially “steps into the shoes” of the negligent driver, meaning that it assumes the liability of the negligent driver for compensation to victims of road accidents.
The RAF is, primarily, financed through a fuel levy, meaning that every time motorists buy fuel, they contribute towards it. This maintains the RAF’s financial stability and ensures that it can pay victims of road accidents.
In South Africa, if someone is injured or killed in a road accident which was caused by the negligent or wrongful acts of a motor vehicle driver, the victim or their family can claim the following compensation from the RAF:
Medical Expenses:
Costs for hospital stays, surgery, and rehabilitation.
Loss of Income:
Compensation for loss of income if the victim cannot work due to their injuries.
Funeral Costs:
Compensation for funeral expenses if the accident results in death.
General Damages:
Compensation for pain, suffering, and permanent disability.
Loss Of Support:
If the main income provider is killed dependents can claim loss of support.
It is possible for victims of road accidents to claim directly from the RAF, but having an attorney by your side significantly increases your chances of a successful claim. An attorney ensures everything is done correctly, helps you navigate the complexities of the process, and works to secure the fair compensation to which you are entitled.
