What can you claim?

If you were injured  in a motor vehicle accident on a South African road and the accident was not your fault, you can claim compensation from the RAF for emergency and other medical expenses; past and future loss of income; general damages for pain and suffering; loss of support in the case of the death of a breadwinner and funeral costs in the case of the death of a family member.

How to claim?

A person (“claimant”) can claim from the RAF in person or by employing the services of an attorney.  A prescribed claim form must be completed and the claim has to be lodged at the RAF. After investigating the claim, the RAF can make an offer and if no offer is made an attorney can proceed with the issuing of a summons out of court. The matter will now follow the legal process until finalization.

Who can claim?

Drivers, passengers, pedestrians, cyclists, and motorcyclists can claim from the RAF, if they were not solely responsible for the accident. The RAF provides cover for both South Africans and foreigners involved in accidents on South African roads.
